Residential Schools (IAP)

More compensation, in addition to the Common Experience Payment, may also be available for certain Survivors. The Independent Assessment Process (IAP) will address sexual abuse claims and the most serious incidents of physical abuse through an out-of-court hearing process before an independent adjudicator.
- Compensation through the IAP will be paid by the Government based upon a determination of the claim by an independent adjudicator.
- If people decide to pursue an IAP claim, they will be charged a contingency fee for the additional compensation awarded which we intend will only be 15%, but only if we succeed in obtaining additional money for the person, and the Government will additionally contribute 15% towards legal costs.
Survivors should contact us for a free consultation to find out if this additional compensation is possible in their case. For Survivors who suffered significant physical abuse or any kind of sexual abuse we may be able to obtain additional compensation for them, just as we have for thousands of clients since 1997 through the courts, settlements, and the IAP. A few years ago, we obtained a judgment for a survivor which exceeded $300,000.00. We settled a case for $200,000.00 in compensation last year and another for $209,000 after that. Depending upon the circumstances that apply in a specific case, the compensation could be large. However, it depends on the individual hearing in each case and your individual facts.
If you have only minor physical abuse you will get nothing more under the IAP. For more serious physical or sexual abuse cases, a significant amount of money might be recovered.
