Baby Products Class Actions

2009 - Merchant Law Group (together with other firms) have commenced five national class actions on behalf of all Canadians who purchased or used many baby products manufactured or distributed by Johnson & Johnson, Laboratoires Expanscience (makers of Mustella brand baby products), L’Oréal Canada Inc., Procter and Gamble Inc., and Kimberley-Clark Inc. The products include (but are not limited to) the following:

  • Johnson’s Baby Shampoo
  • Aveeno Baby Soothing Relief Creamy Wash
  • Mustela Dermo-Cleansing Gel for Hair and Body
  • Pampers Kandoo BrightFoam Handsoap - Magic Melon
  • L’Oréal Kids Fast Dry Shampoo 2 in 1 – Burst of Cool Melon
  • Huggies Naturally Refreshing Cucumber & Green Tea Wash for Hair & Body

These class action lawsuits allege that these products (and possibly other baby bath and hygiene products manufactured by these companies) contain 1,4-dioxane and/or formaldehyde, which are known carcinogens, and which could cause rashes, skin sensitivity, asthma and/or other medical ailments. 

These class actions further claim that same companies failed to list the presence of these contaminants on the labels of the products in question and failed to mention it in their advertising or promotional material. These class actions claim for reimbursement of the price paid for the products as well as other damages and compensation for consumers.
