ISM Lawsuit

Thank you for your interest in the  lawsuit that Merchant Law Group has filed on behalf of those people whose personal information was on the hard drive that was stolen from ISM.  Hopefully this webpage will explain the workings of  class action lawsuits and will answer some of your questions about what we are trying to do for you.

How does a class action lawsuit work?

Please note that this lawsuit has yet to be certified as a class action.  Once the Saskatchewan Court of Queen's Bench has certified this lawsuit to be a class action lawsuit, you will automatically be included in the class action law suit if you are a Saskatchewan resident .  If you are not a Saskatchewan resident you will have the opportunity to opt into the lawsuit at that time.  The Court will likely order that notice be given through advertising in major Canadian news media and will provide for a period of time during which potential plaintiffs could opt into the lawsuit.  If you are a Saskatchewan resident who does not wish to be part of the lawsuit, then you would be able to opt out at this time.

There is no cost or risk to be borne by you in this lawsuit except as outlined under Frequently Asked Questions.  Merchant Law Group is undertaking this lawsuit on a contingent fee basis.  This means that if we settle this lawsuit or win at trial we would be paid a percentage of the settlement or award.  If we fail to win, then we do not get paid.

What we need from you?

All we require from you if you intend to join the Lawsuit is your name, address, phone number, and the organization that had your information on the hard drive.  You can email that information to the special email address we have set up for this matter:  classaction@merchantlaw.com

If you have any questions about it you can email me directly at ISMquestions@merchantlaw.com.
