Residential Schools (IAP)

Merchant Law Group LLP was instrumental in achieving a settlement for Residential School Survivors in Canada.  Survivors of qualifying schools were entitled to receive the Common Experience Payment,andin addition to the Common Experience Payment, significant further financial compensation may also be available for certain Survivors.  

The Independent Assessment Process (IAP) is an adjudication process to provide further financial compensation for sexual abuse claims or serious incidents of physical abuse, through an out-of-court hearing process before an independent adjudicator.

  • Additional monetary compensation for sexualand serious physical abuse will be paid by the Government to Survivorsbasedon a determination of the claim by an independent adjudicator through the IAP. 
  • If people decide to pursue an IAP claim, the Government will additionally contribute 15% towards any legal costs.
