National Class Action
Mega Broker Marsh & McLennan (major commercial insurance provider throughout Canada) sued for alleged multi-million dollar wrongdoing.
February 3, 2005 - Class action lawyer Tony Merchant, Q.C., announced today that he has launched a series of lawsuits in Ontario, Quebec and other provinces, to pursue a new National Class Action against Marsh McLennan.
Through this proposed class action, we seek to recover the millions of dollars which we intend to establish Canadian companies and consumers unknowingly paid on Marsh & McLennan insurance policies. We believe the evidence will show that these fees and incentives were hidden by Marsh from their customers, and used to bait brokers into recommending Marsh McLennan insurance and services, even when better policies might have been available from other competitors.
A broker is supposed to serve as the consumer’s agent, and seek out the best insurance policy, coverage, and price, from the consumer’s point of view. A broker is supposed to be the client’s servant, not the insurer’s pitch man. In this case, we advance, that brokers were more concerned with promoting Marsh McLennan’s interests and products than protecting the consumer and providing the best and most competitive coverage available.
The proposed class action seeks to recover on behalf of both Marsh’s policy holders and its investors, with the two groups identified as:
"All persons (including their estates, executors, or personal representatives), corporations, partnerships, firms, businesses, organizations, and other entities in Canada, and abroad, who purchased insurance or brokerage services from or through the Respondents."
"All persons (including their estates, executors, or personal representatives), corporations, partnerships, firms, businesses, organizations, and other entities, in Canada, and abroad, who are or have been: a shareholder, interest holder, or investor, either directly or indirectly, such as through an agent, a broker, mutual fund, pension fund, or other investment vehicle, in one or more of the Respondent Corporations; or, a beneficiary, pension interest holder, or similar interest holder in one or more of the Respondent Corporations, from January 1, 1995 to present."
