Zonolite - Asbestos Insulation Class Action

Under circumstances where W.R. Grace is operating under bankruptcy protection, and doubt has been cast on the assertion that Zonolite is unsafe when undisturbed, the Canadian law firms which represent Zonolite claimants have reluctantly agreed to a Canadian settlement, under the auspices of a Companies’ Creditors Arrangement Act bankruptcy proceedings. The same settlement discharges W.R. Grace’s potential liability under the Canadian Zonolite class action proceedings. Please take note of the following information.
1. COMPENSATION FOR PROPERTY DAMAGE (CDN ZAI PD Claims)
Under the terms of the settlement, Property Damage Claims can be made against the Settlement Fund. To apply for compensation, you must fill out a printed Proof of Claim Form available online at http://www.graceclaims.com/
CDN ZAI PD Claims can include, among other things, the cost of abatement or removal, the diminution of property value, economic loss, or other property-related claims caused by ZAI Zonolite manufactured by W.R. Grace.
In order to apply for compensation, you must submit a Proof of Claim Form no later than August 31, 2009. You can download the CDN ZAI PD Proof of Claim Form from that website, which you would need to fill out, sign and return by mail to:

Although you may have already completed a Questionnaire on our law firm's website, if you have not already done so, you still need to submit a Proof of Claim Form to the claims processing agent in Minnesota to apply for compensation.
2. COMPENSATION FOR PERSONAL INJURY
A Personal Injury Fund is also to be established, although it may be six months or more before that Fund is established and personal injury compensation applications can be made against it. In order to succeed with a claim against the Personal Injury Fund, a claimant would need to demonstrate evidence of a medical condition which can be established to have been caused by ZAI Zonolite (and not simply asbestos exposure in general). Unfortunately, these personal injuries can often be very serious. Our firm is unable to offer to represent claimants in relation to possible personal injury claims until such time as the Personal Injury Fund is established and the criteria for seeking compensation is known.
