Agent Orange / Agent Purple Class Action

Significant litigation difficulties have been experienced regarding Agent Orange and Purple class actions (collectively known as ‘Agent Orange’) against the Canadian Government.

Merchant Law Group LLP’s work met with initial success. An Agent Orange class action was initially certified in Newfoundland & Labrador by the Honourable Mr. Justice Berry.

Then, another law firm pursued Agent Orange class action certification in New Brunswick. Not only did the N-B Judge not grant certification, his court decision was not favourable about Agent Orange claims overall. The Saskatchewan Court then refused certification for Agent Orange relying heavily on the New Brunswick decision. The Newfoundland Court of Appeal also overturned the certification order granted by the trial division.

An application for leave to appeal to the Supreme Court of Canada regarding the decision of the Newfoundland Court of Appeal was made by MLG but the Supreme Court refused to hear the appeal. While our firm may pursue further class action litigation regarding a very limited group of persons affected by Agent Orange in the future, even if further litigation is pursued that would only potentially provide compensation to a very limited group of affected persons.

We cannot offer to individually represent you in regards to this matter. If you wish to pursue individual litigation with respect to any possible Agent Orange injuries, we strongly recommend that you contact another law firm without delay and/or consider filing an individual lawsuit against the government.
