Capacitors Class Action

Merchant Law Group LLP is pursuing class action litigation on behalf of purchasers of aluminum, tantalum, or film capacitors and/or purchasers of products containing the aforementioned capacitors since 2005 made by various manufacturers including AVX Corporation, Elna Co., Ltd., Hitachi Ltd., KEMET Corporation, Matsuo Electric Co., Ltd., NEC Corporation, Nichicon Corporation, Nippon Chemi-Con Corporation, Panasonic Corporation, Sanyo Electric Co., Ltd., ROHM Co. Ltd., Rubycon Corporation, TDK Corporation, Vishay lntertechnology, Inc., Taiyo Yuden Co., Ltd., Toshin Kogyo Co., Ltd. and Samsung.

This class action litigation alleges inter alia that the defendants conspired to operate as a cartel to foreclose competition and protect their members from price competition and that since at least January 1, 2005, the defendants reached agreements to artificially set prices for their respective aluminum, tantalum, and film capacitors portfolios, by sharing with each other, either through correspondence or otherwise, confidential and competitively sensitive information pertaining to their products and pricing.

Aluminum, tantalum, and film capacitors are utilized in various products ranging from vehicles to everyday consumer electronics, including laptops, tablets, and cellular smartphones.

It is alleged that as a result of the anti-competitive practices of the defendants, purchasers of defendants’ capacitors and the consumers purchasing products containing the defendant capacitors have been overcharged by in excess of $480 million since 2005.
