Wal-Mart Photocentre Data Breach Class Action

Merchant Law Group LLP is pleased to announce the approval of the Wal-mart Data Breach Settlement Class Action.

What is the lawsuit about?

If you are a Canadian Resident and used the Walmart Photocentre Website between June 1, 2014 and July 10, 2015, you may be entitled to compensation.

Who is Eligible for the Settlement? Am I a member of the Class?

You are a member of the Class and entitled to participate in the proceeding if (1) you are a member of the class resident of or are situated in Canada, the estate or legal representative of a class member and (2) you used the Walmart Photocentre website between June 1, 2014 and July 10, 2015 (the “Settlement Class”).

The “Class Period” runs from June 1, 2014 and July 10, 2015, inclusive.

The Settlement has been reached and approved by the Courts

The Proposed Settlement, will provide the following:

Cash Fund: If you are a member of the Settlement Class and have losses caused by the data security incident (including unreimbursed fraudulent charges or time spent remedying any fraudulent charges to your credit card), you will be able to apply for reimbursement of those losses in accordance with the Settlement Agreement. Any Class Member making a claim for out-of-pocket losses may receive $15/hr for up to five hours of time spent remedying those losses, if the Class Member can provide documented evidence of such losses. If a Class Member cannot provide documented evidence of such losses, the Class Member may receive $15/hr for up to two hours of time spent remedying the losses.  The maximum cumulative total available under the Proposed Settlement for the recovery of losses is $400,000.00, to be distributed to Class Members who are eligible and submit a valid claim, in the order in which claims are made.

Monitoring Services:  If you are a member of the Settlement Class, you will be able to apply for free credit monitoring services for up to one year, regardless of whether you submit a claim to the Cash Fund.  If you are a member of the Settlement Class who purchased credit monitoring services as a result of the data security incident, you will be able to apply for reimbursement of the cost of those services in accordance with the Settlement Agreement.  The maximum cumulative total available under the Proposed Settlement for Credit Monitoring is $350,000.00, to be distributed in the order in which claims are made.

Eligible persons may make claims for both reimbursement under the Cash Fund and the Credit Monitoring Service. Walmart and PNI will also pay for the costs of administering these benefits, up to $250,000.00.

To obtain compensation, you will need to submit a Claim Form to the Claims Administrator.

As set by the Court, you will subsequently receive notification of how to access and submit the Claims Form.  If you submit a complete, accurate, valid, and timely Claim Form, the Claims Administrator will send your payment to you in accordance with the Settlement Agreement and after all appeals have been resolved or exhausted.
