Volkswagen/ Audi/ Porsche 3.0-Litre Diesel Emissions Canadian Litigation Options

This MLG webpage concerns potential compensation options regarding certain types of 3.0L owned and leased Volkswagen, Audi and Porsche diesel vehicles. Please note:

  • Our law firm is pursuing individual litigation, on behalf of individuals who do not wish to take part in the 3.0L Volkswagen/Audi/Porsche Canadian class action proposed settlement.

In Canada, Owners or Lessees 3.0L Volkswagen/Audi/Porsche diesel vehicles have a choice:

You can take part in the Canadian class action settlement for 3 L Volkswagen/Audi vehicle owners [details regarding compensation pursuant to that proposed class action settlement is available by calling their “Claims Centre” at 1-888-670-4773 or via their website:].  Our law firm is not involved with that proposed class action settlement.


If you are not satisfied with the proposed compensation option under the  3.0L Volkswagen/Audi/Porsche proposed Canadian settlement, you can “opt out” and take part in individual lawsuits against Volkswagen/Audi/Porsche to seek individual compensation — IF you file an OPT OUT FORM with the above Claims Centre before the “opt out deadline” of March 19, 2018.  IF you opt out, you can then instruct our law firm to pursue litigation for you as part of group of vehicle owners seeking individual compensation, by way of the non-class action litigation being pursued by our law firm against Volkswagen/Audi/Porsche. Or you can pursue litigation through small claims court or as otherwise advised by your lawyer.  [Please note: all affected Canadians are automatically part of the proposed class action settlement UNLESS an opt out form is properly filed by a 3.0L vehicle Owner or Lessee before the above deadline.]

To be clear, affected Owners or Lessees cannot participate in both the Volkswagen/Audi/Porsche Canadian class action and seek to take part in the individual litigation through our law firm.

Some 3.0L Volkswagen/Audi/Porsche Owners and Lessees have retained our law firm (on a contingency/percentage recovery basis) to pursue individual litigation on their behalf.

MLG’s view is that certain 3.0L Volkswagen/Audi/Porsche Owners and Lessees may not receive adequate compensation under the proposed 3.0L Canadian settlement, but individual Owners and Lessees need to make an individual assess their circumstances and individual litigation or class action options (details of which are available from the Claims Centre or their above website).
