General Motors Ignition Switch Class Action
Update – May 30, 2024
The Ontario Superior Court of Justice (per its Order, see in PDF Ontario Amended Certification Order (gmignitionswitchsettlement.ca) of May 7, 2024) and the Superior Court of Québec (per its Order, see in PDF Quebec Amended Certification Order (gmignitionswitchsettlement.ca) of May 6, 2024) have certified for settlement purposes a Canada-wide class action seeking compensation for economic loss property claims by current and former owners or lessees of certain GM vehicles that were recalled in 2014. A proposed Canada-wide settlement (the “Settlement”) has been reached between the parties to the same class action lawsuits. [Please note, the same proposed class action Settlement will provide no compensation options for personal injuries.]
The GM recalls involved the Delta ignition system key rotation, Camaro knee-key, and loss of electric power steering. A table of the eligible vehicles to the Settlement can be found on the FAQs page of the Claims Administrator’s Settlement Website (gmignitionswitchsettlement.ca), which also contains all other relevant information and documents [or view the table of the eligible vehicles here].
Subject to “settlement approval” by the above Courts, the Settlement will establish a class action settlement fund of $12 million CAD to pay expenses and valid claims of eligible Settlement Class Members who submit a Claim Form online or by mail before the Claims Deadline (a deadline which has not yet been established). The Settlement Approval Hearings have been scheduled for July 30, 2024 at 10:00 a.m. (Eastern Time) before the Ontario Superior Court of Justice (virtual only) and for July 31, 2024 at 9.30 a.m. (Eastern Time) before the Superior Court of Québec (virtual or in-person). These hearings are public and can be viewed online. [The Teams/Zoom links for the Settlement Approval Hearings will be posted on our website and the Settlement Website once they are made available by the Courts.]
Unless you wish to “oppose” approval the Settlement or wish to “opt-out” of the Settlement, there are no steps needed from class members, until the Claim Form Process begins in the Fall of 2024 (if the Settlement is approved).
