Indigenous women forced sterilization class action
Merchant Law Group LLP is pursuing proposed class action litigation against some provincial goverments seeking compensation for a group of First Nations women (“Indian women” to use the wording from the legislation) who were subjected to forced sterilization procedures.
The subject-matter tubal ligation/forced sterilization procedures on Indigenous women were performed shortly after they had given birth, without their informed consent. For some members of the proposed class, consent paperwork was presented just after they had given birth, when they were still in labour, or while they were under the influence of painkillers and other medications (or no consent was sought or obtained).
This litigation remains ongoing. Matters of liability remain to be litigated before the Courts.
