This class action alleges that, due to a design flaw, the heating, ventilating, and air conditioning systems (HVAC systems) in the vehicles fail to properly evaporate or drain condensation that accumulates within them, creating a moist, hospitable environment for the growth of bacteria, fungus, mold, and spores.  Drivers of the vehicles affected by the Mercedez Benz HVAC defect report complaints of musky, mildew, and moldy odors.
