    What are the types of fraud?

    Fraud is any crime where you use trickery or deceit to gain money or goods you should not have access to. 

    This can include mass marketing fraud, identity theft, misrepresentation on a loan application, embezzlement, credit card and debit card fraud, services fraud, asset misappropriation, wire fraud, phishing or other internet fraud, investment fraud, or any confidence scam. 



    What are the penalties for fraud in Saskatchewan?

    If you have received less than $5000 from your fraud scheme then it may be treated either as a civil matter or a criminal matter. If it is treated as a criminal matter it is still possible to see jail time for this act. 

    If you’ve received more than $5000 then the charge is always treated as a criminal offense. The maximum sentence in this case is 14 years.

    If you have received more than one million through fraud there is a minimum 2 year sentence attached to this crime. 

    In both cases the courts may require the perpetrator to pay restitution. This would be the amount taken, plus additional damages for any hardships caused by your fraud. 



    What are the possible defences to fraud charges?

    There are several ways we can defend you against fraud charges. One way is to show that you had no intent to defraud the person you were transacting with. Fraud always involves an intent to commit the crime. 

    Another common defence is a “mistake of fact.” For example, if you are accused of making a false statement of fact to get access to loan funds we may be able to prove that this was an honest mistake. It is not against the law to be mistaken, it is only against the law to deliberately lie for your own financial gain.
