    How do I appeal my immigration decision in Ontario?

    You must file your appeal within 30 days of receiving your denial or removal order. Your lawyer will then receive the reasons for your denial or removal order from immigration authorities. 

    After that, the matter may go to Alternative Dispute Resolution. If this is successful then you should be able to remain in the country without a hearing. If it is not successful the court will schedule a full immigration.

    Throughout the process your lawyer will be helping you decide on a legal strategy, working to gather evidence as to why you should be allowed to stay, and will be advising you on how to avoid harming your case in the meantime.

    How long does an appeal take in Ontario?

    You should expect your appeal to take anywhere from six months to two years. It takes roughly 45 days after filing the appeal for immigration authorities to send the facts of your case to your lawyer. It takes roughly six to nine months to enter ADR, if that option is open to you. It may take 12 to 18 months to get a hearing date.

    Try to be patient. Use the time to gather evidence. Work with your lawyer to make sure you’re not harming your case in the meantime.
