In late 2004, the manufacturer of Vioxx voluntarily withdrew it from the market after the data safety monitoring board of the FDA that was performing a study recommended that the study be halted because of an increased risk of serious cardiac events, including heart attack and strokes. The risk was approximately twice that of individuals taking a placebo.

Merchant Law Group launched class proceedings against the makers of Vioxx and other defendants, on behalf of all Canadians who had used this prescription drug (as well as on behalf of families whose relatives may have passed away as a result of using Vioxx).

In February, 2008, a certification judgment was released by the Court allowing this litigation to proceed as a certified class action. Health problems commonly reported from using Vioxx include (but are not limited to) gastrointestinal bleeding, blood clots, heart attacks, stroke, angina, cardiac arrests, congestive heart failure, coronary heart disease, hypertensive, pulmonary edema, pulmonary embolism, sudden death, and other cardiovascular or gastrointestinal conditions and side effects.

Our lawsuit appears to be the only Canadian class action seeking compensation for Vioxx users who experienced gastrointestinal and/or cardiovascular problems (whereas other Vioxx lawsuits seek compensation for cardiovascular problems only).

Our law firm also believes that it is very important (in addition to obtaining substantial compensation for Vioxx users who experienced gastrointestinal and/or cardiovascular problems) that all Canadian consumers should also be reimbursed for the money they paid for Vioxx since 1999 regardless of health problems.
